Malcolm LinsellMalcolm LinsellSpecialist Plastic Surgeon

When he was a toddler, Malcolm suffered full thickness burns to both hands. At the age of 13, the scar on his right hand was improved by a plastic surgeon and from then on, he decided he wanted to “be like that man”. Malcolm attained a Bachelor of Science (BSc), then a Bachelor of Medicine and Bachelor of Surgery (MBBS), and then a Masters of Surgery (MS) at Monash University. 32 years ago, he became a Specialist Plastic Surgeon (FRACS) and now consults and operates in Melbourne, Sydney, Cairns and Rockhampton. Several years ago, he recognised there was a need for a practicing plastic surgeon to provide specialist medico legal advice, and this is now an integral part of his practice. Early in his practice Malcolm operated on a severely burned boy from PNG, whose story was subsequently shown on 60 Minutes. He is the author of 2 books, swims 6 days a week and has remained a loyal fan of AFL club St Kilda, despite the many heartaches that entails.

Maddison SummerhayesMaddison SummerhayesLawyer at Carroll & O'Dea

Maddison works for both plaintiff and defendant clients across a range of matters in the personal injury team at Carroll & O’Dea Lawyers. Since joining the firm in 2019, Maddison has worked on complex medical negligence claims involving obstetrics, gynaecology, vascular, cardiac, urology, paediatrics, general surgery, radiology, cancer and plastic surgery. Maddison has a health care background as a registered nurse in operating theatres (anaesthetics). Her medical experience affords her the knowledge required to understand the technical aspects of claims as well as the compassion required to meet the emotional needs of clients. Maddison’s academic interests have focused on the topic of medical/health law. During her time at university, she completed her honours thesis on the topic of informed consent. Maddison has authored articles published in the health law bulletin. She has a particular interest in the review into the cosmetic surgery sector within Australia.

Emma BartleyEmma BartleyBarrister at Garfield Barwick Chambers

Emma graduated with the University Medal from Western Sydney University with combined Bachelor of Laws (Hons I) and Bachelor of Social Science (Criminology and Criminal Justice). She went on to work as a Tipstaff and the Associate to the Hon Justice Stevenson in the Commercial List of the Equity Division of the Supreme Court of NSW. Emma was called to the Bar in 2020 and appears in all NSW Courts, from the Local Court to the Court of Appeal. A large part of Emma’s practice at the Bar involves professional negligence claims, in particular medical negligence including negligence arising out of cosmetic surgery. Emma is also a Sessional Academic at her alma mater, Western Sydney University, and more recently has taught Contract Law at UNSW, a role in which she gets to pursue other passions—teaching and mentoring. Outside her professional life, Emma is learning to speak Português and plays squash.
